1. Introduction and Company Details
Welcome to FindMyStay. These Terms and Conditions govern your access to and use of the FindMyStay website and platform. The platform is developed and operated by THEVIPGROUP Sp. z o.o., a registered company based in Krakow, Poland.

By registering an account, publishing a listing, or making a booking, you agree to comply with and be bound by these Terms and Conditions.
2. Role of the Platform
FindMyStay acts exclusively as an online intermediary connecting individuals seeking accommodation (Tenants) with accommodation providers (Landlords/Agencies).
- FindMyStay does not own, manage, or lease any of the properties listed on the platform.
- The rental contract is established directly between the Tenant and the Landlord. The content of the rental contract is out of our competences and is arranged strictly by the parties.
- FindMyStay's responsibility is limited to providing the technological infrastructure to display listings, verifying user identities, and facilitating the secure initial booking payment.
Listing Accuracy and Right to Rent: Landlords are solely responsible for the accuracy, legality, and completeness of their listings (including photos, prices, and amenities). By publishing a listing, the Landlord legally guarantees that they own the property or have the explicit legal authorization to rent it out. FindMyStay assumes no liability for fraudulent misrepresentations made by Landlords, illegal subletting, or copyright infringements regarding uploaded property images.
3. Registration and User Accounts
To use our secure booking service, users must register for an account and maintain system integrity.
- Verification: To ensure a secure community, Tenants and Landlords are subject to identity verification, background checks, and KYC (Know Your Customer) or KYB (Know Your Business) compliance using our third-party payment processor, Stripe.
- User Obligations: Users agree to provide accurate information, not to bypass the platform to avoid fees, and to maintain the confidentiality of their login credentials.
- Age Requirement: By registering an account and using FindMyStay, you expressly represent and warrant that you are at least 18 years of age and possess the legal capacity to enter into binding contracts. FindMyStay reserves the right to terminate any account if we discover the user is a minor.
4. Making a Booking and Secure Payments
Our platform utilizes a secure escrow-style payment system to protect both parties during the transaction.
- The Payment Hold: When a Tenant clicks "Request to Book," a hold is placed on their payment method for the first month's rent plus applicable platform fees.
- Confirmation: The Landlord has 24 hours to accept or decline the booking. Upon acceptance, the booking becomes legally binding.
- The 48-Hour Move-In Guarantee: The first month's rent is securely held by our payment gateway. The funds are only wired to the Landlord's bank account 48 hours after the Tenant's scheduled move-in date, provided the Tenant has not reported any significant discrepancies regarding the property condition.
- Security Deposits: Any security deposit required by the Landlord will be clearly stated on the listing and must be handled in accordance with the individual rental agreement.
5. Platform Fees and Subscriptions
FindMyStay sustains its operations through transparent fees and subscriptions.
Tenant Fees
Tenants are charged a non-refundable booking fee at checkout. For short-term stays (under 3 months), the fee is 10% of the total booking value. For mid-to-long-term stays (3+ months), the fee is 7% of the first month's rent only. A minor Trust & Safety fee also applies to cover identity verification costs.
Landlord Fees (Basic Tier)
Listing properties is free. Landlords on the free tier are charged a 7% commission deducted automatically from their first month's rent payout upon a successful booking.
Landlord Subscriptions (Pro Tier)
Professional property managers may opt into our "FindMyStay Pro" subscription for 399 PLN/month. This unlocks advanced software features and reduces the booking commission to 2%.
6. Cancellation and Refund Policy
Cancellations are strictly governed by our detailed Cancellation & Protection Policy, which is fully incorporated into these Terms.
- Tenant Cancellations: Tenants receive a full refund of the rent if they cancel within 24 hours of booking or more than 30 days before move-in. Cancellations made 30 days or less before move-in are non-refundable.
- Landlord Cancellations: Landlords are penalized for cancelling confirmed bookings to protect the Tenant's experience. Cancellations made with less than 30 days of anticipation will trigger a penalty fee of 10% of the first month's rent, a deduction in their Fiability Score, and a negative repositioning in search results.
- Platform Fees: Booking fees and Trust & Safety fees are non-refundable in all cancellation scenarios to cover platform operations and rebooking assistance, except in officially documented cases of Force Majeure.
7. Objections, Complaints, and Dispute Resolution
FindMyStay provides a framework for addressing grievances to maintain service quality.
- Complaints: Any complaints regarding the platform's functionality, payments, or services must be submitted via email to Support@findmystay.eu.
- Disputes Between Users: While the rental contract is out of our jurisdiction, FindMyStay may, in the worst-case scenarios, take the role of arbitration if it is impossible for the parties to fix the situation by themselves regarding the initial booking and move-in process. FindMyStay is not liable for disputes occurring after the 48-hour move-in window.
8. Measures in the Event of Illegal Conduct
FindMyStay reserves the right to take immediate action in the event of illegal conduct, publication of illegal content, or breach of this agreement by the user. This includes the right to remove listings, suspend accounts, and withhold payouts pending investigation.
9. Liability and Force Majeure
- Force Majeure: Neither party shall be held liable for failure to perform their obligations if such failure is caused by unforeseeable events beyond their control (e.g., natural disasters, pandemics, government mandates).
- Limitation of Liability: FindMyStay's liability is strictly limited to the platform fees collected for the specific transaction in question. We are not liable for third-party sites, the physical condition of the accommodations, or damages resulting from the rental agreement.
10. Applicable Law and Final Provisions
These Terms and Conditions and all services provided by FindMyStay are governed by the legal framework of Poland. Specifically, operations comply with:
- The Polish Civil Code
- The Polish Consumer Protection Act
- The Polish Act on Providing Services by Electronic Means (Ustawy o swiadczeniu uslug droga elektroniczna)
- The Polish Telecommunication Law (Prawa telekomunikacyjnego)
- European GDPR Data Protection legal norms regarding Data Privacy and Usage
11. Tax Compliance and Reporting
Landlords and Agencies are solely and exclusively responsible for the accuracy, completeness, and timeliness of all local tax reporting on their rental income. This includes, without limitation, any applicable income taxes (such as Polish PIT), Value Added Tax (VAT), tourist or municipal taxes, and any equivalent taxes imposed by the jurisdiction in which the property is located or in which the Landlord or Agency is tax-resident.
By listing a property or receiving payouts through FindMyStay, the Landlord or Agency warrants that the tax identification number (e.g., NIP, VAT ID, or national tax number) provided during onboarding is true, valid, current, and matches the legal entity or individual entitled to the rental income. Any change in tax residency, VAT registration, or tax status must be updated in the user's account without undue delay.
FindMyStay does not act as a tax agent, tax advisor, or withholding agent on behalf of Landlords or Agencies. FindMyStay uses Stripe Tax to automatically calculate and monitor regional tax thresholds and will notify hosts when cross-border thresholds may require registration in a new country; however, this is provided strictly for informational purposes and does not constitute tax advice or relieve the Landlord or Agency from any filing, registration, or payment obligation.
In compliance with European Union directives (including DAC7) and applicable Polish law, FindMyStay may be legally obligated to report host earning data and tax identification numbers to the relevant Polish or EU tax authorities. By using the platform, Landlords and Agencies agree to provide and keep up to date any accurate tax information required for such reporting, and acknowledge that any inaccuracies are their sole responsibility and liability.
